Urgent Call for Action Following Unlawful Eviction and Inadequate Police Response at 77 Barnes Avenue

Ms. C and her son, residents of 77 Barnes Avenue, Indigo Lincoln, have been victims of an unlawful eviction on 16th August 2024. This distressing event has resulted in significant property damage and theft, leaving the family vulnerable and without the justice they deserve. Despite clear legal protections and subsequent court orders, the landlords’ actions and the inadequate response from the Metropolitan Police Service have exacerbated the situation, causing further distress and insecurity.

Unlawful Eviction and Immediate Aftermath

On 16th August 2024, Ms. C and her son, who has complex disabilities and managed epilepsy, were forcibly evicted from their home by four police officers without proper legal authorization. This eviction occurred despite a scheduled court hearing on 23rd August 2024, which ultimately permitted Ms. C to re-enter her home. The involvement of the police in this eviction has raised serious concerns, as it directly contravened the legal rights of the residents.

Following the court’s decision on 23rd August 2024, Ms. C was informed that she could not return to her property until 3rd September 2024 due to works being carried out by Clearway. Upon her return, she found her home in disarray—personal belongings, including a laptop, valuable jewellery, passports, credit cards, and personal gifts, had been stolen, and extensive property damage had occurred. Additionally, rubbish had been dumped on the property by residents of 73 Barnes Avenue, further exacerbating the situation.

Inadequate Police Response and Escalating Safety Concerns

Despite multiple reports to the Metropolitan Police, including urgent calls made on 3rd September 2024, between 11:30 UTC and 16:00 UTC, no police presence was dispatched to the property. This lack of response is particularly troubling given the gravity of the situation, the previous swift police action during the unlawful eviction, and the ongoing safety concerns for the family.

Ms. C, a mother of three children, including two daughters who were unlawfully removed on 24th March 2023, has faced racial injustice and discrimination throughout this process. The police’s failure to act promptly and appropriately has caused significant emotional distress, particularly for her older son, Mr. Aquayemi-Claude G. Akinsanya, who suffered a severe anxiety attack during the unlawful eviction. Mother and Older Son was able to receive additional advice at a Coffee and Tea Morning at a Local Church in the area of Richmond Park. Where we was able to share our experiences of criminal behaviour by our Landlords with a Met Police officer on the 4th March by the name of Molly Moody. Who shared that she would do her upmost for Police Presence to arrive at the residents of 77 Barnes Avenue. After apologies for the poor Service we have had to experience on the 3rd March 2024. Molly Moody shared that she would present on site with Met Police Officer  Darren. However Later that day we had the presentation of Three Male Police officers,  thought it was intriguing that their were only Three Male Police officers. Where was Molly Moody who is female Police Officer. Which left the Mother feeling out numbered by the Male presence on the afternoon of the 4th March 2024. We appreciate that the Police Officers did arrive on site to visit the crime seen however avoided to visit the nex door residents of 79 which felt like a Racial Injustice diservice to Ms. C Who were not able to have the stolen property returned back to her Garden and the Rubbish removed from her Residents of 77 by 79.

Demands for Justice and Accountability

Ms. C and her representative, Mr. Aquayemi-Claude G. Akinsanya, are now calling for urgent action, including:

1. Restitution of Stolen Belongings: Immediate return of all stolen items, including the laptop, jewellery, print, passports, and other valuable personal effects.

2. Financial Compensation:
Full compensation for the damages incurred, including the value of the stolen items and the cost of property repairs.

3. Thorough Investigation:
A comprehensive investigation into the actions of the Metropolitan Police officers involved in the unlawful eviction and the subsequent lack of response on 3rd September 2024.

4. Legal Accountability:
Prosecution of the individuals involved in the theft and property damage, including the residents of 73 Barnes Avenue.

5. Securing the Property:
Immediate allocation of Balham Locksmith services to secure the property, including replacing the damaged door with an original oak door. Assistance in securing a second residence within the Barnes area is also requested to ensure the safety and well-being of Ms. C’s daughters, allowing them to resume their education at their chosen independent specialist boarding school, which has been delayed due to neglect in providing an Educational Personal Budget by Achieving For Children.

6. Official Apology:
A formal apology from the Metropolitan Police Service, acknowledging the failures in service and providing assurances that such issues will not recur.

Conclusion

The unlawful eviction, significant property damage, theft, and inadequate response from the Metropolitan Police Service have caused severe distress and insecurity for Ms. C and her family. They demand immediate action, a thorough investigation, and justice to ensure their safety and restore their peace of mind.
